Introduction

We are on a mission to make the web a better place. The following terms, as well as our Policy, Terms of Service, and Account Access Policy, apply to all users.

Terms of Service and User Agreement

Welcome to www.paygati.in, the website of NAME HOSTY PRIVATE LIMITED, a company registered under the Companies Act, 2013, India having its registered office at Mohar Sabang Khargapur, West Midnapur, WB 721161, India (hereinafter referred to as “PayGati”, “we”, “us”, or “Company”).

The user using this Website (the “Site”) and the services made available on the Site or on Applications, Tools, Plugins, Extensions, and APIs published on the Site and available for distribution on registered, recognized and official third-party platforms, is subject to these Terms of Service (these “Terms”, “Agreement”).

PayGati provides software and services for paperless, hassle-free documentation, including generation, facilitation, management, and distribution of electronic signatures; storage, sharing, digitization, validation, and verification of documents based on the user’s identity (the “Services”).

The individual or company using or intending to use our Services is referred to as “Customer”, “User”, “you”, or “your”. By using any of our Services, you agree to be bound by these Terms in entirety. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE OUR SERVICES.

This page will be updated whenever there is a change to the Terms. It is your responsibility to check this URL frequently to stay informed about PayGati’s Terms. The then-current version of these Terms will supersede all earlier versions. Continued use after updates implies acceptance of the revised Terms.

Note: The term “PayGati” is a brand name used for identification and does not by itself determine the nature of business.

Ownership of Content

PayGati does not claim ownership rights over documents or files you submit (“Content”). You retain full ownership. These Terms grant us only limited rights required to provide the Services (e.g., copying, storing, extracting data, verifying, sharing strictly as needed) in accordance with our Privacy Policy and applicable laws, with your consent.

Rights & Responsibilities of the User

Rights

  • Subscribe to or discontinue Services at any time (no refunds for partial periods).
  • Unsubscribe from promotional communication at any time (transactional/essential messages may still be sent).
  • Retain complete ownership of your Content as described above.

Responsibilities

  • You are solely responsible for your Content, including any copyright, trademark, or licensing claims.
  • Ensure Content is free from viruses, trojans, malware, or malicious scripts.
  • Safeguard your credentials; notify us of loss, theft, or unauthorized use immediately.
  • Respect confidentiality obligations you have with third parties; do not submit confidential data you are not permitted to share.
  • Do not use the Services to upload or transmit unlawful, harmful, defamatory, obscene, hateful, harassing, infringing, or unsolicited content; do not spread malware; do not disrupt networks; do not violate laws; do not stalk or collect personal data about others.
  • Use trusted devices and networks to access your account; you assume risks when using shared/public devices.
  • You are responsible for third-party claims resulting from your breach of these Terms.

Rights & Responsibilities of the Company

Rights

  • Modify, limit, or discontinue free services at any time.
  • Refuse Services if required registrations or prerequisites are not met.
  • Auto-renew subscriptions unless cancelled by the User (no refunds for auto-renewals already processed).
  • Send transactional and informational messages using provided contact details.
  • Block malicious uploads and terminate suspicious sessions; enforce credential resets.
  • Publish User/Organization name, logo, and comments for case studies or marketing without prior consent.

Responsibilities

  • Maintain security of the Site and systems.
  • Strive for high uptime; communicate scheduled maintenance windows.
  • Protect privacy as per the Privacy Policy.
  • Provide invoices and receipts for all fees.

Intellectual Property

All rights, title, and interest in the Site and Services, and associated intellectual property, are owned by PayGati or its licensors. Nothing in this Agreement grants you ownership or derivative rights. Do not copy, modify, reverse engineer, decompile, or claim our technology as your own.

Third-party software integrated into the Services remains owned by such third parties. Your use is limited to what these Terms allow.

License

Subject to these Terms and unless otherwise approved in writing, PayGati grants a limited, non-exclusive, non-transferable license to use the Services for personal or authorized business use only. You may not sublicense, rent, resell, reverse engineer, or bypass security features.

Privacy Policy

The Privacy Policy is incorporated by reference and may be updated periodically. Please review it to understand how we collect, use, and protect your information.

Representation, Warranties, and Covenants

  • Each Party warrants it has authority to enter this Agreement.
  • PayGati uses commercially reasonable efforts to ensure Services are free from harmful code.
  • Users warrant they will not publish or share illegal, defamatory, obscene, or infringing content via the Services.
  • Users will indemnify PayGati for claims arising from misuse or breach of these Terms.
  • Access to certain Services may require completing registration formalities.

Service Limitations

PayGati offers dynamic QR code generation and facilitates acceptance of payments via UPI-enabled apps. PayGati does not provide payment gateway services and is not involved in payment processing or settlement between customer and merchant. We are not responsible for disputes or financial transactions between parties.
